Some recent events have once again sharply exposed the faultlines of India’s political economy. What the opposition forces today rhetorically and inconsistently call a communal, right-wing, fascist assault on the fundamentals of the Indian Constitution is in reality a manifestation of the growing constitutional crisis of state power in the context of India’s political economy and class-struggle.

जी. एन. साईबाबा और अन्य बनाम महाराष्ट्र राज्य, केस में जिस तरह से सर्वोच्च न्यायालय की एक विशेष बेंच ने छुट्टी वाले दिन, उच्च न्यायालय के फैसले को निलंबित कर दिया, वह विश्व में नहीं तो कम से कम भारत के न्यायिक इतिहास में बिलकुल नया था। जैसा कि कई न्यायविद और टिप्पणीकारों के द्वारा उल्लेख किया गया है कि अब तक मान्य परंपरा रही है कि अदालत के नियमित कामकाज के समय से परे असाधारण बैठकें तब होती हैं जब व्यक्तिगत स्वतंत्रता के मुद्दे शामिल होते हैं या गंभीर संवैधानिक संकट को टालने के लिए होते हैं। यह शायद पहली बार हुआ कि 5 नागरिकों को पुनः जेल में डालने के लिए न्यायालय बैठी। इस जल्दी की क्या अहमियत थी, या यदि वे लोग जेल से बाहर आ जाते तो क्या संवैधानिक संकट खड़ा हो जाता? यह हम माननीय न्यायाधीशों के न्यायिक समझ पर छोड़ देते हैं। वैसे भी भक्ति और अमृतकाल में डूबे देश में कुछ गलत हो इसकी संभावना कम ही है।

The Left movement, if we may still call it a movement, is in constant pain. It’s heart aches on the arrest of the eminent activists of Bheema Koregaon case, it twinges for the arrest of eminent professors, its angst is further exacerbated when other eminent intellectuals mostly high profile activists, academicians, lawyers are arrested or slapped with charges like contempt of court. One can easily say that the Leftists are in constant pain, or shall we say they have become a painful lot?
